What is the extradition agreement between India and Bangladesh?

It is the year 2013. People of India’s North-East militant group were hiding in Bangladesh. The government wanted to stop them from taking refuge in Bangladesh. At the same time, people of Bangladesh’s banned organization Jamaat-ul-Mujahideen were hiding in India. The two countries entered into an extradition agreement to deal with this problem.

Under this, both the countries can demand return of the fugitives taking shelter in each other’s places. However, there is a catch in this that India can refuse to extradite a person in politically related cases, but if serious cases like murder and kidnapping are registered against that person, then his extradition cannot be stopped.

Thanks to this agreement, Bangladesh handed over United Liberation Front of Assam leader Anup Chetia to India in 2015, according to the Dhaka Tribune. India has also sent back many fugitives from Bangladesh so far.

According to a 2016 amendment to the agreement, the country seeking extradition is not even required to provide evidence of a crime. For this, the warrant issued by the court is enough. This increases the difficulties for Hasina.

India may refuse to extradite Hasina. He can say that the allegations made against him have no solid basis. Article 8 of the extradition agreement between India and Bangladesh provides several grounds for refusal of extradition.

In cases where there is insufficient evidence to prove charges or where they involve military crimes that are not recognized under ordinary criminal law, extradition may be refused. Under Article 7 of the India-Bangladesh Extradition Treaty According to this, any country can reject the demand for extradition. Instead, he can talk about prosecuting that person in his country. However, this may have a negative impact on India’s relations with the new government of Bangladesh.
