A bench of Justice BR Gavai and Justice K. Vinod Chandran considered the pleas of Solicitor General Tushar Mehta, appearing for some banks, that it is not practical to deploy security guards round the clock at all ATMs. He said, “In Assam, we have around 4,000 ATMs. We cannot keep security guards at all ATMs. CCTVs have to be kept as a recognized system worldwide. ”

Supreme Court had banned the direction of the High Court

Mehta said that the apex court had stayed the directions of the High Court in December 2016. He said that petitioners, including State Banks of India, have no objection in accepting other instructions issued by the High Court in December 2013 regarding the security protocol for smooth functioning of ATMs. The bench accepted the petition and canceled the directive issued by the High Court stating, “All ATMs should be kept security guards round the clock to ensure that only one customer entered the ATM campus at a time.” Can do it. ”

High court had taken automatic cognizance

The High Court took automatic cognizance of a news published in December 2012 on alleged ATM fraud, which was said to be a fraud of Rs 35,000 with a person. It had issued notice to the Center and Assam’s Director General of Police and the Reserve Bank and the concerned bank to take decisions on security measures that can be provided to ATM customers to avoid such incidents. The High Court order paid attention to the affidavit of the Director General of Police filed in May 2013, suggesting an action plan to provide security to the ATMs of all the banks of the state. The High Court had accepted the suggested plan and directed the officials to ensure its implementation.
