The new foreign law is wrong and against Indianness: Abhishek Manu Singhvi

New Delhi: When the country was busy discussing the Tariff imposed by the Waqf Act and the tariff imposed by US President Donald Trump, the central government secretly passed new immigration and foreign law 2025. Famous lawyer of the Supreme Court, Rajya Sabha MP and Congress spokesperson Abhishek Singhvi described it as ‘unconstitutional, non-Indian and dictatorship’. He says that this law makes ‘being a crime to be foreign’, because it gives an open exemption to harass people without any reason, without hearing and accountability. While talking to Karan Thapar in a 30 -minute interview to The Wire, Dr. Singhvi expressed deep concern over this law. He said, “This law is not to control foreigners, but to give the government unbridled strength and to normalize scary control.”

Working things of law

Abhishek Manu Singhvi explained some dangerous parts of this law:

1. Section 3: Full strength to the government In this section, the government gets an ‘open right’ to put any foreigner in jail or remove it from the country. Dr. Singhvi said, “Any foreigner can be removed without question.” The worst thing, the decision of the immigration officer is ‘last’, there is no appeal, nor hearing, nor any investigation.
2. Section 7: Strict ban on foreigners Under this section, foreigners can be told where they should live, when to meet, when to report and how to treat. Dr. Singhvi said, “Foreigners are not seen as guests, but as an intruder.”
3. Monitoring every step This law ordered landlords, doctors and universities to monitor every activity of foreigners. Dr. Singhvi said, “Every cough, change of every address, admission in every school or hospital will have to be told to the government, otherwise punishment will be given.”
4. Section 14: without proof action In this section, the government can close the places where foreigners often go without proof or allegations. Singhvi described it as ‘punishment on the basis of suspicion’.
5. Section 15: Strength to decide nationality If a foreign foreign keeps two passports, then the government can decide which country it belongs to. Singhvi called it ‘arbitrary’ of the government.
6. Section 26: Big power to small officer In this section, a head constable has been given powers like a very big officer. Singhvi called it ‘strange and dangerous’.

‘This is a very worrying issue’

Singhvi warned that this law would not only stop even foreigners. He said, ‘Today it is targeting foreigners, tomorrow it can also apply to the people of the country. Its effect will not stop on the border. He said that this is a very worrying issue that did not pay as much attention as it should have been. Singhvi said that it was ignored due to focus on Waqf and Trump Tariff.
