
Hearing in Supreme Court on Waqf law
The Supreme Court will hear the petitions challenging the constitutional validity of the Waqf (Amendment) Act 2025 on Thursday. The bench of Chief Justice BR Gavai and Justice Augustine George Christ will hear the important case. Earlier these petitions were heard by a bench headed by former Chief Justice Sanjeev Khanna. However, Justice Khanna retired on 13 May, due to which a new bench has now been formed.
Hearing was held on 17 April
The apex court held the last hearing in the case on 17 April. During that time, the court had registered the assurance of the Central Government that it would neither indulge in the assets of Waqf, including “Waqf by User” by May 05, nor would it be appointed to the Central Waqf Council and Board.
What did the former CJI say during the hearing?
In the April 17 hearing, the Supreme Court indicated that it was considering prohibiting parts of the Waqf Act, 2025, including the concept of ‘Waqf-Bai-Uzer’, representation of non-Muslims in Waqf boards and the rights given to the collector to change the status of disputed Waqf land.
Former Chief Justice of India Sanjeev Khanna said, “We usually do not stop any law in this phase of challenge, unless there are extraordinary circumstances. This appears to be an exception. The hearing bench also included Justice PV Sanjay Kumar and KV Vishwanathan.
