Trump has said that he is going to impose heavy tariffs on the import of medicines soon. After this statement, the Nifty Pharma index fell 2% to 21,600 levels.

Granules India Lupine shares fell to 4%
The shares of Granules India, Lupin, Netcofarm and Aurobindo Pharma fell to 4%. Shares of Laus Labs and Dr. Reddy’s Laboratries also dropped more than 3%. Large names like Sun Pharma, Cipla, Glenmark and Natco Pharma also came down by 2-2.6%.
Export of drugs worth ₹ 86,200 crore from India every year
India exports drugs worth $ 10 billion (about ₹ 86,200 crore) every year from India, which is 6% of the total pharma imports of the US. In such a situation, the news of tariff scared investors.
Earlier in April, Trump spoke of pharma tariff, but later postponed it for 90 days. Now again this statement has increased uncertainty in the market.
Experts say that if the tariff is imposed then the earnings of Indian pharma companies can have a big impact, because a large part of their income comes from the US.

On Wednesday, May 28, a three -judge bench of Manhattan’s Federal Court of International Trade had prohibited the tariff, saying that Trump misused his powers and went out of the scope of the constitution and imposed this tariff.
The court had said that Trump misuses the International Emergency Economic Powers Act (IEEPA). This law gives the President a special right to take some decisions during the Emergency.
However, Trump used these powers without concrete reason. However, this decision of the trade court was overturned by the US Federal Appeal Court.
The court also said this,

President Donald Trump went out of his jurisdiction and imposed a huge tariff on the trade partners. The US Constitution empowers Parliament to regulate trade with other countries. But Trump decided on the tariff by keeping his special rights above the Constitution. Special powers of the President do not mean to do anything by naming any situation as emergency.
The tariff was stopped based on two cases:
- The Liberty Justice Center filed a case on behalf of 5 small American businesses, which were being affected by these tariffs.
- 12 US importers also filed a petition in the court.
Both of them argued that the tariffs are causing heavy losses to small businesses, as their cost was increasing due to the increase in the price of imported goods. The court accepted these arguments as correct and said that the President does not have the constitutional right to put tariffs on such a large scale.
