The Supreme Court has recently given an important verdict. The apex court said that if a woman has been in a live-in relationship for a long time, then the man cannot accuse the man that she had made physical relations with her by falsely promising marriage. The Supreme Court also said that in such cases it is difficult to decide whether the reason behind sexual relations was just the promise of marriage or not.

The case was between a bank manager and his 16 years a live-in partner, who was a lecturer. The woman had alleged that the man had a false promise of marriage and made a physical relationship with her, due to which she had filed a case of rape.

“Both parties were educated”

A bench of Supreme Court Justices Vikram Nath and Sandeep Mehta dismissed the criminal proceedings filed against the man in the case. The court said that both parties were educated and they were related to consent.

Court told the relationship sour

The court also said that the two met each other, even though they were posted in different cities. The apex court described the case as a sour in a relationship.

What did the court say in its decision?

The court said in its judgment, “It is difficult to believe that the complainant accepted the pressure for sexual relations of the accused without any opposition for nearly 16 years, alleging that it was forced to have a physical relationship under the false promise of marriage.”

“There was no cheating between the two sides”

The court also said that the long term of the relationship proves that there was no deception between the two sides. Constant sexual relations between the two over a 16 -year long period indicate that there was never rape or cheating in the relationship.

The Supreme Court also said that when a woman stays in a relationship for 16 years, her allegations that physical relations were made only on the basis of marriage promise, not reliable. Even if the false promise of marriage has been made, the woman’s stay in that relationship for a long time weakens her charge.
