Joseph Laplan, a US Federal Judge, on Thursday decided to ban the order of citizenship associated with the birth of President Donald Trump.
Under this policy of Trump, children born in the US do not get citizenship, who do not have an American citizen or permanent resident (green card holder).
Judge Laplante said that the matter is very serious, because if this policy is implemented, children will be denied American citizenship, which is a huge loss.
The judge described citizenship as the biggest privilege, which should not be taken away. He said that he would approve a class action case (collective case) in this case, which will include all the children who will be affected by this order.
Earlier, the Supreme Court had said on 27 June that the judges of the lower courts could not ban the order of citizenship associated with the birth of Trump. They should reconsider their order again.

On 20 January, Trump signed on the executive order and banned the right to congenital citizenship.
Judge stopped the verdict for a few days
The judge said that they would issue a temporary order (preliminary injunction) to prevent this order from being implemented. Written copy of this decision will be released soon.
Judge Laplante has stopped his decision for a few days, so that the Trump administration can appeal. If there is an appeal, the matter can go to the upper courts.
At the moment, this policy will not be applicable across the country, and children born in America will still continue to get citizenship.
People taking shelter in America filed suit
The case was filed by a pregnant woman, two parents and their newborn children. They were represented by the American Civil Liberty Union (ACLU) and other organizations.
The trial said that this order could harm millions of children and their families. A woman involved is from Honduras, who is going to give birth to her fourth child and has applied for asylum in America.
She said that she does not want her child to be forced to live in fear and hiding. Another man is from Plantify Brazil, who lives in Florida with his wife and his child born in March. They are applying for permanent residence (green card).

Citizenship is not found in 3 situations by Trump’s order
The executive order with which Trump ended the congenital citizenship law is named ‘Protecting the Meaning and Value of American Citizenship’. This order refuses to give US citizenship under 3 circumstances.
- If the mother of a child born in America is living illegally there.
- At the time of the child’s birth, the mother should be legitimate, but temporary resident of America.
- Father should not be a citizen or legitimate permanent resident of America at the time of childbirth.
The 14th amendment of the US Constitution gives the right to congenital citizenship. Through this, the children of immigrants living in America also get the right to citizenship.
Supreme Court order affects Indians
According to data up to 2024 by the US Census Bureau, there are about 54 lakh Indians in the US. This is about one and a half percent of the US population.
Two-thirds of these people are first generation immigrants. That is, he first went to America in the family, but the rest is a US -born citizens. Following the order of the Supreme Court, it will be difficult for First Generation Immigience to get American citizenship.
