‘ED is crossing all boundaries’, Supreme Court has strict remarks about liquor shop license dispute

The Supreme Court today made strict comments on ED i.e. Enforcement Directorate during the hearing in a case. The court said during the hearing of the case that the ED is crossing all limits. At the same time, the court has also stayed investigation in the license dispute of liquor shops against the Tamil Nadu government and TASMAC. Let us know that ED Tamil Nadu’s liquor is investigating money laundering regarding retail company TASMAC.

The Supreme Court said during the hearing on the petitions filed by the Tamil Nadu government and the Tamil Nadu State Marketing Corporation (TASMAC), “ED is crossing all limits and violating the federal concept of governance. The matter was heard by Chief Justice BR Gawai and Justice Augstin George Messen. Additional Solicitor General SV Raju presented by side told that “Your ED is crossing all boundaries.”

There was a case of 1000 crore scam

The bench added, “Enforcement Directorate (ED) is violating the federal concept (of governance).” At the same time, the bench said that the ED investigation against the state -run TASMAC will not proceed in the meantime. On this, the law officer protested that the case is related to financial corruption more than Rs 1,000 crore and ED is not at least crossing boundaries in this case.

Further, the bench noticed the arguments of Senior Advocate Kapil Sibal and Amitanand Tiwari that the state has lodged more than 40 FIRs in cases related to license allocation of liquor shops since 2014 and now the ED has also raided TASMAC. On this, the bench asked the ED’s lawyer, “How can you raid the state -run TASMAC?”

What is the matter?

The ED raided TASMAC campuses a few days ago on the money laundering case, after which the DMK government of Tamil Nadu and TASMAC approached the Supreme Court against the raids conducted by the ED. Earlier, the government had turned to the High Court, in which their petitions to carry forward the ED’s action were rejected. In these petitions, the Madras High Court’s order of 23 April was challenged. Explain that in its order, the High Court had allowed the ED to continue its action under the Prevention of Money Laundering Act (PMLA), which has been stayed by the Supreme Court.
