A couple who dreamed of buying a flat in Gurugram had to face 10 years of builder delays and false promises. Even after booking a flat worth Rs 1.16 crore in 2013, he neither got the flat nor got the money back. On the contrary, the builder repeatedly convinced him to invest the money in other projects.

The couple booked the flat in 2013 by paying a booking amount of Rs 12 lakh. In 2014, a total amount of Rs 1.07 crore was paid by paying Rs 95 lakh and a sale agreement was made. But when he went to see the flat, he came to know that even the basic construction work had not started yet.
When the buyer canceled the booking from the builder and asked for a refund, the builder convinced him to invest in another flat worth Rs 1.55 crore. However, this flat was also not ready on time. When possession of the flat was not received even by 2022, the buyer lodged a complaint with Haryana RERA.
Haryana RERA investigated
Haryana RERA, while hearing the case, found that unit number 3016 was allotted during the first booking in November 2013. Second booking was canceled in the year 2017 and unit number E-2144 was allotted in Sector 67A. The new agreement was signed in January 2018. Third Booking Then again in the year 2021, another flat (Unit No. 1571-D Block) was allotted. Due to delay in construction, the builder had promised to hand over the possession of the flat by July 27, 2022, but did not even receive the occupation certificate from the concerned authorities.
Haryana RERA gave this decision
RERA held the builder guilty and asked it to compensate the buyer for the basic amount of Rs 1.07 crore along with an interest rate of 11.1% per annum. Interest will be calculated from the date of payment till receipt of the actual amount. Haryana RERA orders builder to return Rs 2.26 crore. This includes a refund of Rs 1.07 crore and 11.1% annual interest. This decision is an important step in protecting the interests of the buyer.
Justice for buyers and warning to builders
This case is an example for thousands of home buyers who are facing delays and non-promises from builders. This decision of RERA proved that the law is capable of protecting the interests of buyers and is also ready to fix accountability of builders.
