The Supreme Court on Tuesday refused to grant custody of her grandson to the mother of AI engineer Atul Subhash, who committed suicide due to alleged harassment by his wife, saying she (Atul’s mother) is a ‘stranger to the child’. A bench of Justice Bela M.Trivedi and Justice N.Kotishwar Singh heard the case. During this, Nikita’s lawyer also told the address of the child in the court. The court was hearing the habeas corpus petition of Subhash’s mother Anju Devi, in which she had sought the custody of her 4-year-old grandson.
‘The child is a stranger to the petitioner’
The Supreme Court bench said during the hearing, “We are sad to say that the child is a stranger to the petitioner. If you wish, please meet the child. If you want the custody of the child, there is a separate procedure for this.” Is.” Further said that the issue of custody of the child can be raised in the lower court.
It is noteworthy that 34-year-old Atul Subhash was found hanging in his house in Munnekollu area of ​​Bengaluru on 9 December 2024. He had also reportedly left a long message, in which he held his wife and in-laws responsible for his suicide.
The lawyer told the address of the child
During the hearing, the lawyer appearing for estranged wife Nikita Singhania told the Supreme Court about the address of the child and said that the child is currently studying in a boarding school in Faridabad district in Haryana. The lawyer further said, “We will take the child to Bengaluru. We have taken him out of school. To fulfill the bail conditions, (the child’s) mother will have to stay in Bengaluru.”
Atul Subhash’s mother’s lawyer made this allegation
Atul Subhash’s mother’s lawyer Kumar Dushyant Singh sought custody of the child and alleged that his daughter-in-law, who was living separately, was hiding the child’s whereabouts. He argued that a child below 6 years of age should not be sent to a boarding school and cited the photograph taken when he (the child) was only 2 years old to show the good interaction of the child with the petitioner.
After this, the bench directed to present the child in the court on the next hearing on January 20 and said that the case cannot be decided on the basis of ‘media trial’. Let us inform you that on January 4, a Bengaluru court had granted bail to Subhash’s estranged wife, her mother Nisha Singhania and brother Anurag Singhania in the case of abetment of suicide.
