Did not vacate the house for 63 years and the house is surrounded by arbitrary? The father got tired of fighting a legal battle .. Then the sons continued this legal war. But it is strange that 63 years have passed to get our own house. 2 generations of a family were engaged in the fight to get a house. The tenant comfortably removed so many years into a posh area house. One such case ran in court for 63 years and finally in April 2025, the Supreme Court gave the property to the children of the property owner.
When did the legal battle start?
The case began in 1952 when a person (A) rented some people (b) for 10 years. In 1962, this property was sold to someone else (C). In 1965, the new owner (C) noticed that the tenants were sitting on land without permission, then they filed a case of eviction in the court. But in 1974, the case lost in the Supreme Court.
Did not stop even after defeat
In 1975, the owner (C) again filed a case in the district court. The matter reached the High Court in 1999, but also lost from there in 2013. During this time the owner died and his children continued the legal battle. Finally, on 24 April 2025, the Supreme Court pronounced the decision in favor of the owner’s children.
What did the Supreme Court say?
The tenant’s lawyer argued that after the death of the owner, his children could not proceed to the old case as the case was filed on the basis of his father’s need. On this, the Supreme Court said that there is a need to understand the Bonfied requirement on a large scale and it also includes the needs of family members. The court also said that according to Section 21 (7) of Uttar Pradesh Urban Building (Regulation Act) 1972, even after the death of the owner, his valid heir (children) can carry forward the case.
Court strict on tenants
The Supreme Court said that these tenants have been in this property for 73 years, of which 63 are without legal rights. He did not try to make any alternative arrangements over the years. It is clear that he deliberately captured the property.
What will happen now?
The Supreme Court has ordered that tenants will have to vacate the property by 31 December 2025. If they have not yet paid the rent, the entire fare will have to be paid. This historic decision of the Supreme Court makes it clear that the real owner of the property and his valid successors can get justice in the court for their rights.
