The first section is 163A and the second section is 166. The first section states that if a person dies in a road accident, his family can claim compensation.

Section 166 is applied in an accident due to negative

Section 166 is for cases of such road accidents, in which it is clear that the accident happened due to the negligence of another person. In such a situation, the family members of the victim of the accident may claim compensation from the owner of the vehicle or the vehicle owner. However, he has to prove that the accident happened due to the fault of another person. For example, if the drawer of the truck is driving carelessly, it causes an accident, then the family of the victim of the accident can prove the driver’s negligence in the court and seek compensation.

Insurance of a person victim of accident is not necessary

Even if the victim of the accident has not been insured, he is entitled to compensation. Actually, third party insurance is necessary for all trains in India. In this, if a person dies of a vehicle, he is injured, then the insurance company has to pay compensation to the victim or his family. In such a situation, it is not necessary to have insurance of the victim of the accident.

Compensation is also available in hit and run case

Many times the accident occurs due to the negligence of the driver. He escapes as soon as the accident occurs. In such cases, it is not known from which vehicle the accident happened or who was driving the car. Such cases are called Hit and Run Case. In such a situation, the family of the victim of the accident cannot demand compensation from any insurance company, because the collision vehicle is not identified. In such cases, the government created a Motor Vehicle Accident Fund in 2022 to help the people. If the person dies in the accident from this fund, then his family gets Rs 2 lakh. If the person is wounded in a befriend, then he gets a compensation of Rs 50,000.
