Giving an important verdict in this case, the court has ordered the bank to return Rs 94,000 to the victim. Actually, in this case, a fraud of Rs 94,000 was committed with a young man from Assam, who had a bank account in SBI and the cyber criminal had stolen all the Rs 94,000 deposited in the young man’s SBI account.

The young man had bought a blazer worth Rs 4000 in 2021

According to an Economic Times report, in 2021, the young man had purchased a blazer worth Rs 4000 from the website of fashion brand Louis Philippe. The young man returned the blazer and wanted a refund. In 2021, Louis Philippe’s website was hacked and personal details of many customers were sold for money. Using this detail, cyber criminals called the young man posing as a customer care officer and said that he would have to download an app for the refund. As soon as the app was downloaded, the criminals got access to the youth’s SBI account and transferred Rs 94,204 deposited in the account to an account of Federal Bank. After this, he made several transactions in Federal Bank and sent all the money to many different accounts.

Didn’t get relief even from RBI Banking Ombudsman

As soon as the young man came to know about the fraud, he first called SBI customer care and informed about it. Along with this, the youth also lodged a complaint with his nearest police station and cyber crime cell. The young man did not get any benefit in complaining to SBI, instead the bank employees started calling the victim careless. After which the young man lodged a complaint against the bank in the RBI Banking Ombudsman. But even here the young man did not get any relief. After this the young man filed a complaint against the bank in the Gauhati High Court.

Supreme Court upheld the High Court’s decision

Amidst the hearing of the case in Guwahati High Court, Guwahati Police caught the criminal from Uttar Pradesh, who was living there under fake identity. During the hearing of the case, the High Court found the bank guilty of negligent working style and ordered it to recover the money from the arrested criminal and return Rs 94,000 to the victim. The High Court found that the victim had informed the bank shortly after the fraud took place but the bank did not take any appropriate action on it. SBI challenged the High Court order in the Supreme Court. Where the Supreme Court upheld the decision of the Gauhati High Court and ordered the bank to return Rs 94,000 to the victim.
